  • Jurisdiction: Either you or your spouse must be an Australian citizen, permanent resident, or have lived in Australia for the past 12 months.
  • The 2-Year Rule: If you have been married for less than 2 years, the court usually requires a counseling certificate or special permission to file.

Note on Children: If you have children under 18, the court needs to be satisfied that proper arrangements are in place for their welfare before granting the divorce. This does not mean you need a formal custody agreement, just a clear breakdown of their living setup.
